 What if I have a blue card and am charged with a disqualifying offence or placed under a temporary offender prohibition order?

 If you are a current blue card holder and you are charged with a disqualifying offence, you are obliged to immediately notify the Commission and any relevant employer that there has been a change in your police information.

Your blue card will be suspended and you can not continue in regulated child-related activities. A letter will be sent to you and to any relevant body advising that your blue card has been suspended.

You may apply to the Commission to have your eligibility to hold a blue card re-assessed. You will need to complete and submit an ‘Notification – change in police information’.

The Commissioner will review your application after your charge is finalised in court. If your charge is finalised, and you are sentenced to a term of imprisonment the Commission must cancel your blue card and issue you with a negative notice.

If the charge against you is not proceeded with or the charge is finalised and a penalty other than imprisonment is imposed, the Commissioner will re-assess your eligibility to have your blue card continued.

If the Commissioner decides that your blue card should be continued, a letter will be sent to you and any employer associated with your application advising that your blue card is no longer suspended and your positive notice and blue card has been continued.
