 How do I make an application for an ‘eligibility declaration’?

You will need to complete and submit an ’eligibility declaration application form’ to the Commissioner. Please refer to the schedule of fees for the applicable application fee.

The Commissioner can only issue an ‘eligibility declaration’ if satisfied that yours is an exceptional case which would not harm the best interests of children.

As part of the Commissioner’s decision making process in deciding whether you have an exceptional case, you may be given the opportunity to provide submissions and references in support of your ‘eligibility application’.
The Commissioner can not issue an ‘eligibility declaration’ where a person:

  • has been sentenced to imprisonment to imprisonment for a disqualifying offence; or
  • have current reporting obligations under the Child protection (Offender Reporting) Act 2004; or
  • are subject to a child protection offender prohibition order; or
  • are subject to a disqualification order made by a court.
