Regulated business

Education programs conducted outside of schools

A person carrying on a business needs a blue card if:

  • the usual activities of the business include, or are likely to include-
    • providing services or conducting activities under sections 286(2), 291 or 304 of the Education (General Provisions) Act 2006 for an alternative education program to allow a student who has been suspended or excluded to continue his or her education; or
    • providing services or conducting activities under section 182 or 183 of the Education (General Provisions) Act 2006 for an alternative education program to allow flexible arrangements for a student, instead of the student taking part in the school’s educational programs in the usual way.

A business is not a regulated business if:

  • the business is conducted by a “provider” under section 232 of the Education (General Provisions) Act 2006.
